1. Scope

These Terms and Conditions apply to all contracts between Akixa

Our order process is conducted by our online reseller Dodo Payments (dodopayments.com). Dodo Payments is the Merchant of Record for all orders and appears as the seller on your bank or credit card statement.

3. Subject of Contract

3.1 Scope of Services

Akixa provides personalized astrological analyses and horoscopes based on birth data provided by the customer.

3.2 Entertainment Purpose

All astrological analyses, reports, readings, and interpretations provided through our Services are for entertainment and self-reflection purposes only. They are not intended to:

Predict future events or outcomes
Replace professional advice (medical, legal, financial, or psychological)
Guarantee any specific results or life changes
Provide factual assertions about your future
By using our Services, you acknowledge and agree that astrological content is subjective interpretation based on astronomical positions and should be treated as entertainment.
3.3 Digital Products

All products are delivered exclusively digitally. No physical shipping occurs.

4. Contract Formation

4.1 Offer

The presentation of products on our website does not constitute a legally binding offer but an invitation to order.

4.2 Order

By clicking the "Order with obligation to pay" button, you place a binding order.

4.3 Acceptance

The contract is concluded upon our order confirmation via email.

5. Prices and Payment

5.1 Prices

All prices shown are final prices including applicable VAT.

5.2 Payment Methods

Payment is processed through our online reseller (Merchant of Record) Dodo Payments. The following payment methods are accepted:

5.3 Due Date

The purchase price is due immediately upon contract conclusion.

6. Delivery and Performance

6.1 Provision

Personalized horoscopes are provided via email within 24 hours of payment receipt.

6.2 Access Credentials

You will receive access credentials for your personal customer account via email.

7. Right of Withdrawal

7.1 Withdrawal Instructions

Consumers have a fourteen-day right of withdrawal. The complete withdrawal instructions can be found under "Right of Withdrawal".

7.2 Expiry of Withdrawal Right

The right of withdrawal expires for digital content if you have expressly agreed that we begin contract performance before the withdrawal period expires.

8. Warranty

Statutory warranty rights apply.

9. Liability

9.1 Limitation of Liability

We have unlimited liability for damages resulting from injury to life, body or health, as well as for intent and gross negligence.

9.2 Slight Negligence

In cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal duties).

11. Dispute Resolution

11.1 EU Dispute Resolution

11.2 Consumer Arbitration

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

12.1 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 Jurisdiction

The place of jurisdiction for merchants is Berlin.

12.3 Severability Clause

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
